Welcome to Be The Penguin (the "App"). These Terms of Use ("Terms") govern your access to and use of the App. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must stop using the App.

The App is owned and operated by Ajju Kota.

1. Acceptance of Terms

By using the App, you confirm that:

  • You are at least 13 years old
  • You agree to comply with these Terms
  • You consent to the processing of your data as described in the Privacy Policy

If you are under 13, you may not use the App.

2. Description of Service

Be The Penguin is a cinematic goal-tracking app that allows users to:

  • Create personal goals
  • Track progress using logs and metrics
  • View progress visually through animated screens
  • Create subgoals
  • Access premium features (if purchased)

The App provides an online account system using Supabase, enabling users to store goals and progress securely.

3. User Accounts

To use the App, you must create an account using:

  • Email OTP, or
  • Third-party login (Google or Apple)

You are responsible for:

  • Maintaining the confidentiality of your login information
  • Ensuring the security of your account
  • Not sharing your account with others

We may terminate or suspend access if suspicious activity is detected.

4. Premium Subscriptions

Some features require a subscription purchase via the Apple App Store.

4.1 Billing

  • Payments are processed through the App Store.
  • We do not collect or store payment information.
  • RevenueCat is used to manage subscription entitlements.

4.2 Refunds

Refunds must be requested directly from Apple, in accordance with their policies.

4.3 Entitlements

Premium features unlock automatically upon successful purchase verification.

5. User Content

You may create or input information such as:

  • Goals
  • Logs
  • Subgoals
  • Metrics

You retain ownership of your content. By using the App, you grant us permission to store and process this content solely for providing the service.

We do not sell or share your content with advertisers.

6. Acceptable Use

You agree not to:

  • Use the App for illegal activities
  • Attempt to access unauthorized areas or servers
  • Modify, reverse engineer, or copy the App's code
  • Upload harmful content
  • Abuse or exploit any part of the App

Violating these guidelines may result in account termination.

7. Data Storage & Security

We use Supabase to securely store your data and manage authentication.

Although we take reasonable steps to protect your information, no system is 100% secure. You use the App at your own risk.

8. Availability of Service

We strive to keep the App operational at all times, but we cannot guarantee:

  • Uninterrupted service
  • Complete accuracy of stored data
  • Immediate bug fixes

The App may be updated or temporarily unavailable for maintenance.

9. Termination

We may suspend or terminate your access if you:

  • Violate these Terms
  • Misuse the service
  • Engage in fraudulent activity

You may also delete your account at any time by contacting: kotajju@gmail.com.

Account deletion permanently removes your data within 30 days.

10. Intellectual Property

All content in the App — including images, animations, UI elements, branding, and design — is owned by Be The Penguin and protected under copyright laws.

You may not:

  • Copy
  • Modify
  • Reproduce
  • Redistribute
  • Use any content for commercial purposes without permission

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Loss of data
  • Inaccurate progress tracking
  • Bugs or app malfunctions
  • Device damage
  • Financial losses

Your use of the App is voluntary and at your own risk.

12. Changes to Terms

We may update these Terms if needed. Continued use of the App after changes means you accept the updated Terms.
